Terms of Service

1. Acceptance of Terms

By accessing, registering for, or using the services provided by EPA Sports Training (“Company,” “we,” “our,” or “us”), you agree to be bound by these Terms of Service (“Terms”). If you do not agree to these Terms, you must not use our services or website.

2. Eligibility

EPA Sports Training provides services to individuals of various ages. Participants under the age of 18 must have the consent of a parent or legal guardian. By enrolling a minor in our services, the parent or legal guardian agrees to be bound by these Terms on behalf of the participant and accepts responsibility for the participant’s conduct and participation.

3. Services Provided

EPA Sports Training provides athletic training, sports performance coaching, camps, clinics, fitness instruction, and related services. Services may include, but are not limited to:

  • Private training sessions
  • Group training sessions
  • Sports camps and clinics
  • Performance development programs
  • Digital or online coaching content

We reserve the right to modify, suspend, or discontinue any service, program, or offering at any time without prior notice.

4. Assumption of Risk and Liability Waiver

Participation in sports training, conditioning, exercise, and related physical activities involves inherent risks, including but not limited to serious bodily injury, illness, permanent disability, or death. By participating in our services, you acknowledge and agree that:

  • You voluntarily assume all risks associated with participation.
  • You understand that athletic activities can be physically demanding and may involve contact, exertion, and unpredictable conditions.
  • EPA Sports Training, its owners, employees, coaches, contractors, affiliates, and representatives shall not be liable for injuries, losses, or damages arising from participation, except as otherwise required by law.

By participating, you release and hold harmless EPA Sports Training and its representatives from claims, demands, damages, or causes of action related to participation in training or use of our services.

5. Medical Acknowledgment

You represent and warrant that you, or the participant you are registering, are physically able to participate in athletic and fitness activities. You agree to disclose any medical conditions, injuries, limitations, or concerns that may affect safe participation. If you are unsure whether participation is appropriate, you should consult a physician before engaging in any training activity.

In the event of a medical emergency, you authorize EPA Sports Training to seek emergency medical care if deemed necessary. EPA Sports Training is not responsible for providing medical insurance or covering medical expenses.

6. Payment, Fees, Cancellations, and Refunds

All fees for services, programs, camps, or training sessions must be paid in accordance with the pricing and payment terms provided at the time of registration or booking. EPA Sports Training reserves the right to require payment in advance.

Cancellation, refund, and rescheduling policies may vary by service and may be communicated separately. Any such posted or provided policies are incorporated into these Terms by reference. Failure to make timely payment may result in denial, suspension, or termination of services.

7. SMS / Text Messaging Terms

By providing your mobile phone number and opting in, you consent to receive text messages from EPA Sports Training. These messages may include, but are not limited to:

  • Appointment reminders
  • Scheduling confirmations or changes
  • Program updates
  • Account-related notifications
  • Promotional or marketing messages, if you have opted in to receive them

Message Frequency: Message frequency may vary depending on your interaction with our services.

Message and Data Rates: Message and data rates may apply based on your wireless carrier plan.

Opt-Out: You may opt out of receiving SMS messages at any time by replying STOP to any text message. After opting out, you will receive a confirmation message and will no longer receive SMS messages from us unless you opt in again.

Consent: Consent to receive text messages is not a condition of purchase. By opting in, you confirm that you are the authorized user of the mobile number provided or have authority to provide consent.

Mobile Information: We do not sell or share your mobile phone number or SMS consent information with third parties or affiliates for their own marketing purposes.

8. Participant Conduct

All participants are expected to behave respectfully and safely at all times. This includes, but is not limited to:

  • Following coach and staff instructions
  • Respecting other participants, staff, and facilities
  • Refraining from abusive, disruptive, dangerous, or inappropriate conduct

EPA Sports Training reserves the right to suspend or remove any participant from a session, program, or facility without refund if conduct is deemed unsafe, disruptive, or inappropriate.

9. Intellectual Property

All website content, training materials, videos, graphics, branding, logos, written materials, programs, and other content provided by EPA Sports Training are the property of EPA Sports Training or its licensors and are protected by applicable intellectual property laws.

You may not reproduce, distribute, modify, republish, transmit, or exploit any content without prior written permission from EPA Sports Training.

10. Website Use

You agree to use the website and services only for lawful purposes. You may not:

  • Attempt to gain unauthorized access to any portion of the website or related systems
  • Interfere with the operation or security of the website
  • Use the website to transmit malicious code, spam, or harmful content
  • Engage in scraping, automated access, or misuse of the website or its content

We reserve the right to restrict or terminate access to the website for violations of these Terms.

11. Limitation of Liability

To the fullest extent permitted by law, EPA Sports Training shall not be liable for any indirect, incidental, consequential, special, or punitive damages arising out of or related to the use of our services, website, or participation in training activities.

To the extent liability cannot be fully disclaimed, the total liability of EPA Sports Training for any claim arising out of or relating to these Terms or our services shall not exceed the amount paid by you to EPA Sports Training for the applicable service giving rise to the claim.

12. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Tennessee, without regard to its conflict of law principles.

13. Changes to These Terms

EPA Sports Training reserves the right to update, revise, or modify these Terms at any time. Any changes will become effective upon posting to the website or otherwise providing notice. Your continued use of the website or services after changes are posted constitutes your acceptance of the revised Terms.

15. Entire Agreement
